INTRODUCTION
This page together with our Privacy Policy provide you with information about Sound Leisure Ltd (“Us”, “We”) and the legal terms and conditions (the “Terms”) which govern your use of our website, www.soundleisure.com (the “Website”.) Should you purchase any item from Sound Leisure Ltd (The “Product”) via the Website or via any other method, the Terms also govern the contract which is formed between Us and you (the “Contract”) including but not limited to how orders are placed, accepted and delivered and the scope of the Full Warranty or Limited Warranty associated with Product (The “Manufacturer Warranty” or the “Warranty”.) These terms are effective from 1st September 2021.

1. PRODUCT INFORMATION
a) The images shown on the Website of our products are for illustrative purposes. The colours and finished look of our Products may vary. The colour reproduction of the Products is a close representation of the true colour of the Product; however, We cannot accept any responsibility for any variation in colour caused by the browser software or computer system you use. We provide free sample swatches of all our cabinet finishes and recommend customers request these where any uncertainty exists over the colour and finish of our Products.

b) Our Products are handmade using natural timbers and therefore may vary in texture, grain, knots, pigment, pattern, weight and colour. The stains and dimensions shown in the Product images are examples only and may vary.

c) Each Product purchased is sold subject to its product description and specification. We will take reasonable care to ensure that the details, descriptions, specifications and prices of Products displayed on the Website are correct and relevant at the time of entry. Although We aim to keep the Website up to date, the information including product descriptions and specifications appearing on this Website at a time, may not always reflect the Product at the exact moment you place an order. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

d) Many of our Products are bespoke/made to order made and may take up to 12 months to deliver. If there is a manufacturing delay, We will contact you to inform you.

e) Bespoke/made to order Items will not be eligible for a refund unless a reasonable exception can be made by Sound Leisure Ltd.

f) The Products will be packaged to allow suitable and safe transport. We have no responsibility for the disposal of the packaging.

2. HAND MADE BY HUMANS, NOT ROBOTS
a) We make a choice to ensure the majority of our components and Products, including all our Classic Jukeboxes are handcrafted by real people. We do this because we know our customers want something unique and personal and because it adds to the character of each Product We produce. Because we choose to manufacture this way, some of our components may include small imperfections. These should not be viewed as faults; they are just part of the character of each individual machine and a testament to its hand-built nature. Any such imperfections or differences should not significantly affect the overall aesthetic of the Product or its ability to be used as intended.

b) All wooden components may contain varied wood grain, colour variation, medullary rays and knots. These are naturally occurring features and should be expected with any wood product.

c) We will not accept returns, cover the costs of adjustments/alterations, offer refunds, reimbursements, discounts or compensation due to issues arising from the customer’s personal preference with respect to the above unique Product characteristics.

3. PRICING
a) All prices are shown in Great British Pound Sterling and include VAT.

b) Free UK Mainland delivery is included with some, but not all of our Products. Where free UK mainland delivery is included with a Product, this information will be clearly shown on the relevant product pages of this Website. In all other cases, delivery costs will be incurred in addition to the purchase price of the Product.

c) Free delivery to locations outside the UK mainland is not included with any of our Products.

d) Where free delivery is not included with an item, the relevant delivery costs will either be:

i) calculated and displayed at the point you checkout, or

ii) Communicated to you following our receipt of your order. Where this is the case, you will be informed of this during checkout and given the opportunity not to proceed with your order.

4. QUOTES
a) Our quotes remain valid for 30 days, after this time We reserve the right to change prices accordingly in line with the current material/manufacturing costs and existing listing prices. Prices are subject to change without advanced warning.

5. PLACING AN ORDER
a) You can place orders as follows:

i) By following the ordering process outlined on our Website via the secure checkout method

ii) By contacting Us by telephone

iii) In person at our factory / showroom or pop up shops

b) These Terms apply to all orders, regardless of how they are communicated to Sound Leisure Ltd.

c) Successful order placement via any method available will be deemed as acceptance of these Terms and creates a Contract between you and Us.

d) After you place an order via our Website, you will receive an automatic email from Us confirming that We have received your order. This email does not mean that your order has been accepted. You will need to wait to receive an email confirming your order has been accepted.

e) If We are unable to accept your order, We will inform you of this in writing and will not charge you for the goods and/or We will refund you any money you have paid in advance for the goods. We reserve the right to refuse any order for any reason.

f) Where orders are placed on our Website and paid for in full via the checkout, you will:

i) receive an email confirmation of your order.

ii) If you have ordered a full-size Classic Jukebox, you will also receive a Sales Order Acknowledgement from Sound Leisure Ltd.

g) If you place an order with Us via the telephone or in person at our premises, you will receive a Pro Forma invoice.

h) If We have agreed to accept a deposit for your order (e.g. via our Book a factory build slot offer) you will then be required to make full payment of the stated deposit. We will only process and formally accept your order following receipt of the agreed deposit.

i) Payment of any remaining balance on your order will then be required prior to dispatch of the Product.

ii) Should the payment not be received prior to the scheduled dispatch date/time of the Product, Sound Leisure reserves the right to cancel a scheduled delivery. All cancellation fees and any additional delivery charges that occur as a result of late payment will be charged to the customer.

i) If you are paying in full for your Product at the point of order, you will be required to make full payment for the order as detailed on the Pro Forma invoice. We will only process and formally accept your order following receipt of the agreed payment.

6. CHANGING YOUR ORDER
a) Changes to orders after they have been placed but prior to dispatch may only be permitted at the sole discretion of Sound Leisure Ltd so long as your request to change is communicated to Us prior to our commencement of the manufacture of your Product.

b) If you do wish to change an order you have placed with Us, please contact us via email using sales@soundleisure.com or contact our Customer Services team by telephone on +44 (0)113 2321700 or by post to our registered office at the top of this page. We will let you know if the change is possible. If it is possible, We will communicate any changes to the price of the goods, the timing of supply or any other details which are relevant and necessary as a result of your requested change. We will then ask you to confirm whether you wish to proceed with the change.

c) Once an order has been placed, the cost of any alterations, administrative costs, and additional/updated design drawings will be charged to the customer. Sound Leisure Ltd cannot be held responsible for any resulting delays.

7. CANCELING ORDERS & REFUNDS
a) If you are a consumer then for most goods bought online you have a legal right to change your mind within the Cooling-off Period and receive a refund. You have 14 days after the day you receive the goods. (Consumer Contracts regulations 2013)

b) Your right as a consumer to change your mind and any right to an exchange under these terms does not apply in respect of any Bespoke (built to order) Products. Where a Product is Bespoke (built to order) this will be clearly shown on our Website product pages. We may, at our sole discretion allow you to cancel a Bespoke Product so long as you request the cancellation prior to our commencement of the manufacture of your Product. We cannot accept cancellations or offer a refund for Bespoke Products where the manufacture process has already begun.

c) Please ensure all details are correct before placing your order, and that you are happy with all design decisions and materials.

d) To request a cancellation of an order and request a refund you can email Us on sales@soundleisure.com or contact our Customer Services team by telephone on +44 (0)113 2321700 or by post to our registered office at the top of this page. If you are emailing Us or writing to Us, please include details of your order to help us to identify it. If you send us your cancellation notice by email or by post, then your cancellation is effective from the date you send us the email or post the letter to Us. For example, you will have given us notice in time as long as you get your letter into the last post on the last day of the Cancellation Period or email us before midnight on that day.

e) If you cancel your order within 14 days of the order been placed, We will:

i) Issue your refund minus a 5% credit card processing fee if you paid for your order via a debit or credit card. In addition We may reduce your refund where appropriate to cover any delivery costs (if already booked and/or delivered), plus any other reasonable costs accrued by Sound Leisure Ltd. Please note We are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way that goes beyond that necessary to establish the nature, characteristics and functioning of the Products as might be reasonably allowed in a shop

ii) make any refunds due to you as soon as possible and in any event within 14 days of:

1. the day on which you provide Us with evidence that you have sent the Product back to Us; or

2. if you have not received the Product or you have received it and We have offered to collect it from you: 14 days after you inform Us of your decision to cancel the Contract.

f) If you cancel your order, you must return the Products to Us within 14 days of the date of cancellation. The delivery costs of returning the Products remains your responsibility.

g) Where We delivered the Product or chose a specific courier to do this on our behalf, We may insist on collecting the Product ourselves. The approximate cost of returning the Products will depend on the type of Product and delivery. For Products delivered via Standard Delivery the cost for Us to collect the Product will be up to £750.00. For jukeboxes delivered via Non-Standard Delivery the cost will be up to £2,500.00 depending on your specific requirements.

h) Notwithstanding the terms of this clause, if you have returned the Products to Us under this clause because they are faulty or incorrectly described, We will refund the price of the Products in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to Us.

i) We will refund you on the credit card or debit card used by you to pay. If a Product has been delivered to you before you decide to cancel your Contract, and could not, by its nature, normally be returned by post We will collect the Products from the address to which they were delivered.

8. RETURNS
a) We endeavour to always send out quality Products, however mistakes can occasionally happen. Should you receive incorrect, faulty or damaged items:

i) You should notify Us as soon as is reasonably possible but within 14 days or receipt of your order. Please contact Us via email using sales@soundleisure.com or contact our Customer Services team by telephone on +44 (0)113 2321700 or by post to our registered office at the top of this page.

ii) You should provide a detailed description in writing, with photographs and/or videos of any area(s) that are incorrect, damaged or defective.

iii) Provided evidence is received within 14 days of the delivery date of your order, We will assess the mistake or fault and arrange to repair or replace the item(s) as soon as reasonably possible.

b) In the case of incorrect, faulty or damaged goods, or an incorrect order being received, We will ensure all necessary steps are taken to provide you with the correct item(s), however We cannot offer any refunds, reimbursements, discounts or compensation as a result of any mistake on our part.

c) We cannot offer refunds, reimbursements, discounts or compensation for orders delayed by the following:

● Any act of nature (such as a natural disaster, flooding, snow etc)
● Pandemic/War/Other Disaster.
● Government enforced restrictions/laws.
● Delivery delays (including those related to stock/material supply).
● Where a person would be at risk of harm.

9. OUR CONTRACT WITH YOU
a) Completion of Contract between you and Sound Leisure Ltd will take place as follows:

i) Where We are delivering and installing the Product, on completion of the delivery or

ii) Where We are not completing the delivery and installation, on dispatch of the Products ordered from our premises.

b) In the unlikely event We are unable to fulfil your order, We will notify you as soon as possible. We are unable to cover losses, offer refunds, reimbursements, discounts or compensation as a result of cancelling your order.

c) The Contract is between Sound Leisure Ltd and yourself. No other person shall have any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise. However, if you have purchased a Product as a gift, you may transfer the benefit of our Warranty to the recipient of the gift without needing to ask our consent. Sound Leisure Ltd will not need any such recipient’s consent to cancel or make any changes to these terms.

10. LEAD TIMES
a) Nearly all our Products are bespoke/made to order. All such items will be manufactured to our current estimated lead time as stated on the relevant product pages of this Website. The lead time is reviewed monthly and can increase or decrease significantly without warning. Customers should always check the current lead time for Products with a member of our team prior to placing an order as any such changes to lead times may not yet be accurately reflected on the Website.

b) We will always endeavour to complete orders within the estimated lead time, however, due to the nature of the orders and how they are made, delays may occur . Should an item(s) be delayed for any reason, we are unable to cover losses, accept returns, offer refunds, reimbursements, discounts or compensation.

c) We will not be subject to any subsequent arbitrary delivery dates requested/insisted upon by the buyer as a result of changes to the lead time at the point that the order is placed or any delays to the subsequent lead time.

11. DELIVERIES WITHIN THE UK
a) We offer free delivery to mainland UK addresses on many of the products available on the site or include the delivery charges in the displayed price. If delivery is free or included with any product on our site, this information will be clearly shown on the relevant product page.

b) Jukeboxes – All our Classic Jukeboxes include free ‘Standard Delivery’ to mainland UK addresses but this is only applicable where the delivery requirements meet the ‘Delivery terms (Jukeboxes and large items)’ which are provided at 13. Please read these terms carefully before placing your order.

i) Following confirmation of your Sound Leisure Classic Jukebox order, We will ask you to complete an online ‘Delivery Questionnaire’ which We will use to establish your specific delivery requirements. If you are unable to complete an online Delivery Questionnaire We will provide a printed version which must be returned to Us.

ii) If your jukebox delivery does not qualify for free ‘Standard Delivery’ it is likely We will still be able to complete your delivery but additional charges may apply. A member of our team will work through all the delivery options and associated costs to ensure your delivery can be completed safely and successfully.

c) Other Products – Delivery is free or included in the price of many of our accessories, spares and other ‘none jukebox’ items but unfortunately it’s not possible to do this for every Product. Where delivery is free or included in the cost of any item on this website, this information will be shown on the relevant product page.

d) d) Some of our Products are either too delicate, too heavy or too valuable to trust to couriers, in which case We prefer to ship these items on our own vehicles, driven and taken care of by our own staff. Where possible We minimise delivery costs to UK customers by grouping deliveries by region.

e) Where UK delivery is not free or included with an item, shipping costs to your desired location will be determined once your order has been received. If you are unhappy with the delivery cost We provide, you can either choose to make your own delivery arrangements or cancel your order or receive a full refund. Customers are also welcome to collect items from our factory/showroom in Leeds, West Yorkshire.

12. DELIVERIES OUTSIDE THE UK
a) For deliveries outside the UK mainland, shipping costs to your desired location will be determined once your order has been received. If you would like more information regarding all our delivery options or would like to obtain a delivery quote for any of our Products before making a purchase, please just get in touch using the contact form and a member of our team will assist with your inquiry.

b) There are restrictions on some Products for certain international delivery destinations. Where this is the case, this information will be detailed on the relevant product pages of this Website. Please review the information on each product page carefully before ordering Products.

c) If you order Products from our Website for delivery to an international delivery destination, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination. You will solely be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

d) You must comply with all applicable laws and regulations of the country for which the Products are destined. Sound Leisure Ltd will not be liable or responsible if you break any such law.

e) Jukeboxes – For deliveries outside the UK mainland, shipping costs to your desired location will be determined once your jukebox order has been received. If you are unhappy with the delivery cost We provide, you can either choose to make your own delivery arrangements or cancel your order or receive a full refund.

f) In territories where We have a local distributor, partner or local reseller, We may encourage customers to take advantage of this facility. Our local representative will then take care of shipping your jukebox from the UK to your delivery location, handle all the import/export procedures and paperwork and ensure your jukebox is delivered safely to your home. They will then continue to support and assist you with your ownership journey over many years.

g) Please note, Product prices may vary in each country/territory and between individual resellers and this is beyond the control of Sound Leisure Ltd.

h) Customers are also welcome to make their own shipping and delivery arrangements. Where this is requested a member of the Sound Leisure team will liaise with you and provide the following details to assist you with organising your shipment:

● A collection reference
● A commercial invoice
● The collection date & time

i) Customers must then obtain from their shipper and provide to Sound Leisure a proof of export, this can be a Bill of Lading, Airway Bill or similar official document to demonstrate the Products have left the country. If you fail to provide such evidence you will subsequently be charged 20% VAT on the value of the goods you have purchased.

j) Where customers make their own shipping and delivery arrangements, SL’s terms are ‘Ex Works Leeds’ which means at the point the package leaves our factory door, the shipper assumes full responsibility for the goods. Should the shipment subsequently be damaged or lost, the client and shipper are entirely responsible for resolving any such issues or claims.

k) Where customers choose to make their own shipping and delivery arrangements, SL will pack and prepare the shipment ready for collection by the customer’s agent. All jukeboxes (including slim line cabinets models) shipped to delivery addresses outside the UK mainland must be packed and prepared for either air freight or sea freight. The following criteria and costs apply:

i. Jukebox Air freight Packaging:
▪ Jukebox is bubble wrapped
▪ Horizontal pallet is covered in cardboard
▪ Jukebox is laid flat on its back on the pallet and fixed in position
▪ OSB (Smartply) wooden crate assembled around jukebox and fixed to pallet
▪ Packaging inserts placed around jukebox
▪ OSB (Smartply) wooden lid screwed in place
▪ Case and pallet strapped together
▪ Cost: £200.00 per jukebox ex VAT*

ii. Jukebox Sea freight Packaging:
▪ Jukebox is bubble wrapped
▪ Vertical pallet is covered in cardboard
▪ Jukebox is stood upright on pallet and fixed in position
▪ Open topped cardboard box placed over jukebox and fixed to the pallet
▪ Packaging inserts placed around jukebox
▪ Cardboard box lid closed and sealed
▪ Case and pallet strapped together
▪ Cost: £60.00 per jukebox ex VAT*

l) Please note: *Sea and Air freight packaging prices are correct at the time of writing (September 2021) but may vary from the costs shown on this page. Please ensure you obtain an up-to-date packaging quote before placing your order with Us. Prices are subject to change without advance warning.

m) Other Products – Shipping costs to your desired location will be determined once your order has been received. If you are unhappy with the delivery cost We provide, you can either choose to make your own delivery arrangements or cancel your order or receive a full refund.

13. DELIVERY TERMS (JUKEBOXES AND LARGE ITEMS)
a) While We make every effort to deliver your order on the agreed date, Sound Leisure Ltd shall not be liable for any failure to complete a scheduled delivery if such failure is due to circumstances beyond our control.

b) Free ‘Standard Delivery’ – Free Standard Delivery is included with all our jukebox Products for customers whose delivery requirements meet the following conditions:

1. Delivery must be to a UK mainland address

2. Delivery must be to a GROUND FLOOR location (not a basement or cellar)

3. Parking must be available either on a driveway for the property or directly outside the property

4. The route from the parking location to the property (pathway or drive) must be solid, concrete, tarmac, flagged or gravel

5. Delivery of the item to its final position within the property must be able to be made without the need to go up or down more than two consecutive steps

6. Delivery of the item to its final position within the property can be made through existing gateways, doors or other access points without any impedance or additional requirements. Please check the dimensions of your specific model as cabinet dimensions vary across our range.

7. Delivery must be made Monday to Friday (excluding bank holidays) between 9.00am and 3.30pm

    Non-Standard Delivery – Non-standard delivery is applicable if any of the above conditions (13.b.1 to 13.b.7) are not met, or if any of the following conditions (13.b.8 to 13.b.11) apply:

8. Delivery of the item to its final position within the property can only be made by passing over grassed or lawned areas. This requires specific additional equipment when making the delivery to ensure the item does not sink into the soft surface

9. Delivery of the item to its final position within the property can only be made by passing over significant slopes which requires the item to be handled by more than one person

10. Unavailability of parking or parking restrictions – if local parking is not available or is restricted or likely to make delivery more difficult or time consuming (e.g. city centre locations)

11. You require a specific, timed delivery on a weekend, bank holiday or outside our standard delivery hours as detailed above at 7

14. CUSTOM SHOP JUKEBOX OPTIONS & COMPONENTS
a) Our Custom Shop jukebox options allow customers to customise many of the components and artwork elements on our range of Classic Jukeboxes. Where Custom Shop components are available for a model, these options will be displayed on the relevant product pages of this Website (after clicking ‘Configure and Buy’.)

b) Each Custom Shop option is shown using simple graphical illustration. In each illustration, the item shown in pink relates to a specific Custom Shop component. The cost for each Custom Shop component is shown individually.

c) If you order a Classic Jukebox which includes any Custom Shop components, We will initially contact you to discuss your ideas for the custom components. Our design team will then develop concepts for each Custom Shop component to your specific requirements. The Custom Shop artwork and concepts will then be submitted for your approval.

d) Where multiple Custom Shop components are specified on a single Classic Jukebox order, at our discretion We may choose to provide a design presentation which illustrates the overall look of the jukebox, including any or all of the Custom Shop components.

e) In order to provide a fixed cost for each Custom Shop jukebox option, We analysed a wide range of previous Custom Shop projects to establish the average creative labour and production costs associated with each option. We have then allocated to each Custom Shop component:

i) A maximum creative labour time associated with the design of the custom component, the ‘Creative Cost’

ii) A maximum manufacturing cost associated with the production of the custom component, the ‘Manufacturing Cost’.

f) The combined ‘Creative Cost’ and ‘Manufacturing Cost’ for any individual Custom Shop component is referred to as the ‘Total Production Cost.’

g) At the point We accept your order, as We have no client specific information as to the requirements for each Custom Shop component, we make an assumption that We will be able to produce the Custom Shop components to your specification within the allocated ‘Total Production Cost’ We have established.

h) Following our initial discussions with you regarding any Custom Shop components you have ordered, if We believe the associated cost for designing and producing any individual Custom Shop option to your specification exceeds the ‘Total Production Cost’ We have established for that part, Sound Leisure Ltd reserve the right to:

i) Suggest an alternative specification for that part, to ensure the ‘Total Production Cost’ falls within the established limits for that Custom Shop part.
ii) Provide a revised quote for that part based on the actual ‘Total Production Cost’ incurred in the production of the Custom Shop part to the client’s specification.

iii) Cancel or amend the customer’s order, in whole or part and issue a refund where appropriate. Where any design/creative work has been carried out on behalf of a customer prior to the cancellation of their order, the cost of this work will be calculated based on our standard hourly labour rate and deducted from the value of the refund.

i) If you have requested Custom Shop elements which include as part of their design, any third party IP, including but not limited to texts, copyright works and related rights, registered trademarks, unregistered trademarks, trade names, logos, illustrations, photos, graphics, files, designs, arrangements & fonts, you will be asked to sign a Custom Shop Waiver which specifies you have obtained all the relevant rights and permissions to use any such third party IP and indemnifies Sound Leisure Ltd against all liabilities which may result from their use.

j) Sound Leisure Ltd will not commence the manufacture of any Custom Shop components featuring third party IP, until We have received Custom Shop Waiver from a client for each relevant Custom Shop component. Once your Custom Shop Waiver has been received, should you then wish to subsequently cancel or amend the design this will incur costs based on our standard hourly labour rate, plus any other reasonable costs accrued by Sound Leisure Ltd.

k) Sound Leisure Ltd will not commence the manufacture of any Custom Shop components until We have received emailed or written approval from a client for each individual Custom Shop component. Once your approval has been received, should you then wish to subsequently cancel or amend the design this will incur costs based on our standard hourly labour rate, plus any other reasonable costs accrued by Sound Leisure Ltd.

l) Schedule 1 details the maximum allocated Creative time per Custom Shop component

15. WARRANTY CONDITIONS
The conditions below describe the prerequisites and scope of the Manufacturer Warranty options provided by Sound Leisure Ltd.
a) The Full Warranty conditions apply where Products are purchased directly from Sound Leisure Ltd for delivery and operation in the United Kingdom mainland only.

b) The Limited Warranty conditions apply where Products are purchased directly from Sound Leisure Ltd for delivery and operation outside the UK mainland, only where the appropriate technical conditions (e.g. voltage, frequency) are met and there is no legal restriction (e.g. missing approbation or declaration of conformity).

c) The Reseller Warranty conditions apply where Products are purchased via an authorised Sound Leisure Ltd reseller for delivery and operation in any country or territory, which for the avoidance of doubt may include the United Kingdom. In this instance, the customer’s warranty for the Products is provided directly by the reseller and not by Sound Leisure Ltd. Products purchased via resellers are subject to the warranty conditions published by the appropriate reseller. Please check with your local representative to confirm their warranty conditions before purchasing.

d) d) Both the Full Warranty and Limited Warranty are provided to the customer directly by Sound Leisure Ltd and are therefore both referred to as a Manufacturer Warranty. For the avoidance of doubt, a Reseller Warranty is not provided to the customer by Sound Leisure Ltd and is therefore not a Manufacturer Warranty

e) The Manufacturer Warranty does not affect your statutory rights or the obligations.

f) Outside of the above listed scope, the Manufacturer Warranty will become void.

16. FULL WARRANTY TERMS
a. Sound Leisure Ltd provider cover for our Products subject to the following conditions:

i) We will rectify defects affecting the Product which are clearly attributable to material and/or manufacturing faults, provided they are reported immediately after being identified, and within the Warranty period.

ii) Warranty provision will be free of charge with the exclusion of shipping costs associated with the return of parts or Products to Sound Leisure Ltd. In all cases, Sound Leisure Ltd will decide if the repair or replacement of the affected part or Product is most appropriate. Please note that replaced parts pass into our ownership.

iii) Smaller Products or items and parts that can be transported or posted may need to be shipped to Sound Leisure Ltd and We will decide when this is a requirement. All other repairs will be completed on site.

iv) A purchase receipt must be presented in each case showing the date of purchase. This will allow Us to establish the dispatch date from Sound Leisure Ltd, which elicits the start of the 12 month Warranty period unless otherwise agreed in writing with Sound Leisure Ltd.

v) In order to fulfil the obligations of this Warranty, Engineers and Service Partners must be given reasonable access when attending to the Product.

vi) Where a site visit is required in order to investigate or carry our repair work in relation to any Warranty claim, our initial visit will occur when an member of our staff is next scheduled to be in your local area, or within 21 days of the fault been received by Us.

vii) The provision of services under Warranty neither extends the term of the Warranty nor sets in motion a new Warranty period.

viii) The Warranty period for spare parts fitted ends with the expiry of the Warranty on the Product as a whole.

b) Warranty liability will not be triggered by minor variances from nominal features which are of no significance to the Products value or fitness for purpose, or damage caused by the chemical or electrochemical effects of water and generally by exceptional environmental conditions, inappropriate operating conditions, or the appliance having come into contact with unsuitable materials.

c) Likewise, no Warranty liability will be accepted if the defects stem from transport damage for which We are not responsible, improper installation and assembly, improper use, poor maintenance or failure to observe operating or assembly instructions.

d) We reserve the right to invalidate the Warranty:

i) If repairs are performed by persons not authorised by Us to take such action, or if our Products are fitted with non-original spare parts, extras or accessories.

ii) In the event of physical or verbal abuse towards any member of staff.

e) Other claims against the Warranty in respect of compensation for consequential or associated loss are excluded, except where such liability is legally mandatory.

f) We also offer to repair Products which fall outside the Warranty period on a chargeable basis, this consists of labour call out and charge(s) for spare parts where We deem that appropriate repair can be affected.

g) Where parts are required to be returned to Sound Leisure Ltd under the terms of this Warranty, any associated transport costs remain the liability of the customer.

h) Where Sound Leisure are required to ship replacement parts to a customer under the terms of this Warranty, any associated transport costs remain the liability of Sound Leisure Ltd.

i) We may vary these Terms from time to time provided that such changes do not materially affect the nature and quality of the warranty provided hereunder.

17. LIMITED WARRANTY TERMS
a) This is a Return to Base Warranty only

b) Sound Leisure Ltd provide Warranty cover for our Products subject to the following conditions:

i) We will rectify defects affecting the Product which are clearly attributable to material and/or manufacturing faults, provided they are reported immediately after being identified, and within the Warranty period.

ii) Warranty provision will be free of charge with the exclusion of shipping costs associated with the return of parts or Products to Sound Leisure Ltd. In all cases, Sound Leisure Ltd will decide if the repair or replacement of the affected part or Product is most appropriate. Please note that replaced parts pass into our ownership.

iii) Following consultation with our technical support department, at our discretion We may dispatch replacement part(s) or Products to you to assist with the Warranty repair. You will be charged for any replacement part(s) or Products in the first instance, then any associated charges will be credited on receipt of the faulty part(s) or Products from you.

iv) A purchase receipt must be presented in each case showing the date of purchase. This will allow Us to establish the dispatch date from Sound Leisure Ltd, which elicits the start of the 12 month Warranty period unless otherwise agreed in writing with Sound Leisure Ltd.

v) The provision of services under Warranty neither extends the term of the Warranty nor sets in motion a new Warranty period.

vi) The Warranty period for spare parts fitted ends with the expiry of the Warranty on the appliance as a whole.

18. EXTENDED WARRANTY TERMS
a) The Extended Warranty can be applied to the following Manufacturer Warranty types only:

i) A Full Warranty

ii) A Limited Warranty

b) The Extended Warranty, as sold by Sound Leisure Ltd cannot be applied to a Reseller Warranty, however your local reseller may offer an extended warranty option. Please check with your local representative to confirm their warranty options before purchasing.

c) The Extended Warranty extends the duration of the relevant Manufacturer Warranty cover by 24 months.

d) The maximum total duration for any Extended Warranty provided by Sound Leisure Ltd is 36 months. (E.g. Full Warranty or Limited Warranty = 12 months + Extended Warranty = 24 months, total = 36 months.)

e) Where purchased, the Extended Warranty will commence automatically on the termination date of the relevant Manufacturer Warranty.

f) The Extended Warranty can be purchased at any time within the term of the relevant Manufacturer Warranty

g) The Extended Warranty cannot be purchased after the term of the relevant Manufacturer Warranty has elapsed.

h) The Extended Warranty extends the term of the Manufacturer Warranty only. In all other respects, the terms of the Full Warranty and Limited Warranty remain exactly as defined herein.

19. LIABILITY
a) We only supply the Products for your personal use, and you agree not to use the goods for any resale purposes.

b) Nothing in these terms limits or excludes our liability for:

i) death or personal injury caused by our negligence;

ii) fraud or fraudulent misrepresentation; or

iii) any other liability that cannot be limited or excluded by law.

c) Subject to clause 19b, We will under no circumstances be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with this Contract for:

i) any loss of profits, sales, business, or revenue;

ii) loss or corruption of data, information or software;

iii) loss of business opportunity;

iv) loss of anticipated savings;

v) loss of goodwill; or

vi) any indirect or consequential loss.

d) Subject to clause 19.b, our total liability to you for all losses arising under or in connection with this Contract, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, will in no circumstances exceed the price of the goods.

e) Except as expressly stated in these terms, We do not give any representations, warranties or undertakings in relation to the goods. Any representation, condition or warranty which might be implied or incorporated into these terms by statute, common law or otherwise is excluded to the fullest extent permitted by law. In particular, We will not be responsible for ensuring that the goods are suitable for your purposes.

20. SUBMISSION OF UNSOLICITED IDEAS
a) Should you choose to submit unsolicited ideas and concepts to Sound Leisure, you agree that:

i) your submissions and their contents will automatically become the property of Sound Leisure Ltd without any compensation to you

ii) Sound Leisure Ltd may use or redistribute the submissions and their contents for any purpose and in any way

iii) there is no obligation for Sound Leisure Ltd to review the submission or provide any feedback to you

iv) there is no obligation to keep any submissions confidential

21. OTHER IMPORTANT TERMS
a) We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these terms. We will always notify you in writing or by posting on this webpage if this happens.

b) You may only transfer your rights or your obligations under these terms to another person if We agree in writing. However, if you have purchased a Product as a gift, you may transfer the benefit of our Warranty to the recipient of the gift without needing to ask our consent.

c) Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

d) If We fail to insist that you perform any of your obligations under these terms, or if We do not enforce our rights against you, or if We delay in doing so, that will not mean that We have waived our rights against you and will not mean that you do not have to comply with those obligations. If We waive a default by you, We will only do so in writing, and that will not mean that We will automatically waive any later default by you.

e) Please note that these terms are governed by English law. This means a Contract for the purchase of Products through our Website and any dispute or claim arising out of or in connection with it will be governed by English law. By placing an order with Us, you agree that the courts of England and Wales will have exclusive jurisdiction.
